Bayswater Property Services Ltd. (“BPSL”), David Wayne Vandenberg (“Vandenberg”), and Cameron Matthew Firth (“Firth”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder without a valid BC Housing (“BCH”) Residential Builder Licence between the period of, or about, December 24, 2020, and March 30, 2022, regarding a new home in West Vancouver, BC (the “New Home”). On March 30, 2022, BCH issued Compliance Order 22-0004 to BPSL, Vandenberg and Firth directing that BPSL, Vandenberg, and Firth:
- Cease carrying on the business of a residential builder as defined in the Act. More specifically, to cease engaging in, arranging for or managing the construction of the New Home; and
- Cease the above-noted activities until such time as BPSL, Vandenberg, and Firth become a BCH Licensed Residential Builder pursuant to section 14(1) of the Act.
BPSL, Vandenberg, and Firth were ordered to comply with Compliance Order 22-0004 by May 11, 2022.
