On July 16, 2015, pursuant to s. 28.3(1)(a) of the Homeowner Protection Act (the “Act”), and
s. 20.1(2)(b) of the Homeowner Protection Act Regulation (the “Regulations”), Annalise Toporowski (“Toporowski”) was issued a monetary penalty in the single amount of $5,500. The monetary penalty was issued for the following reasons:
- Toporowski, contrary to section 14(1) of the Act, sold a new home in North Vancouver, B.C., as a new and never occupied home on, or about, May 30, 2014, without being a Homeowner Protection Office Licensed Residential Builder;
- The contravention of the Act by Toporowski makes Toporowski subject to a monetary penalty pursuant to s. 28.3(1)(a) of the Act and s. 20.1(2)(b) of the Regulations.
