0814112 B.C. Ltd. (“0814112”) and Roland Stanley Nadon (“Nadon”), constructed a new home in Kelowna, BC (the “New Home”), between the period of, or about, January 16, 2013, and October 7, 2014. Although 0814112 was a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”)(33168) between June 21, 2010, and August 1, 2014, and obtained a commitment from an approved home warranty insurer on January 16, 2013, to provide home warranty insurance on the New Home as required by the Homeowner Protection Act (the “Act”) and the Homeowner Protection Act Regulation, the New Home was de-enrolled from home warranty insurance coverage by the home warranty insurer at the request of 0814112 on October 7, 2014, contrary to section 22(1) of the Act. On March 26, 2015, the HPO issued Compliance Order 15-0017 to 0814112 and Nadon directing that 0814112 and Nadon:
- Immediately:
- apply for and become an HPO LRB pursuant to section 14(1) of the Act; and
- register the New Home for coverage by home warranty insurance provided by a warranty provider pursuant to section 22(1) of the Act.
0814112 and Nadon were directed to comply with Compliance Order 15-0017 by April 24, 2015.
