On December 10, 2014, pursuant to s. 28.3(1)(b) of the Homeowner Protection Act (the “Act”), 0827697 B.C. Ltd. (“0827697”), Bella Lorenzo Bland (“B. Bland”), and William Bland (“W. Bland”), were issued a monetary penalty in the daily amount of $490 to a maximum of $14,700, until the demands contained in Compliance Order 14-0048 (the “CO”) have been satisfied. This Monetary Penalty was issued for the following reasons:
- 0827697, B. Bland, and W. Bland failed to comply with the CO issued by the Homeowner Protection Office (“HPO”) on July 3, 2014. The date for complying with the CO was August 8, 2014. The failure of 0827697, B. Bland, and W. Bland to comply with the CO makes 0827697, B. Bland, and W. Bland subject to a monetary penalty pursuant to s. 28.3(1)(b) of the Act;
- 0827697, B. Bland, and W. Bland, contrary to s. 14(1) and s. 22(1) of the Act, built the New Home without being in possession of a valid HPO Licence and without the New Home being enrolled with a policy of home warranty insurance;
- The CO directed 0827697, B. Bland, and W. Bland to apply for and become an HPO Licensed Residential Builder pursuant to section 14(1) of the Act, and register the New Home for coverage by home warranty insurance provided by a warranty provider pursuant to section 22(1) of the Act; and
- 0827697, B. Bland, and W. Bland failed to comply with the orders contained in the CO by the requested compliance date.
