0914603 B.C. Ltd. (“0914603”) and Matthew Thomas Renfrow (“Renfrow”), constructed a new home in Victoria, BC (the “New Home”), between the dates of October 3, 2011, and June 11, 2012. Although 0914603 and Renfrow had been a Homeowner Protection Office (“HPO”) Licensed Residential Builder (34856) since September 8, 2011, and obtained a commitment from an approved home warranty insurer on September 8, 2011, to provide home warranty insurance on the New Home as required by the Homeowner Protection Act (the “Act”) and the Homeowner Protection Act Regulation, the New Home was de-enrolled from home warranty insurance coverage by the home warranty insurer on April 3, 2013, contrary to section 22(1) of the Act. On July 8, 2013, the HPO issued Compliance Order 13-0030 to 0914603 and Renfrow directing that 0914603 and Renfrow:
- immediately arrange for home warranty insurance pursuant to section 22(1) of the Act on the New Home.
0914603 and Renfrow were directed to comply with Compliance Order 13-0030 by August 2, 2013. Complied.
