On April 23, 2026, pursuant to s. 28.3(1)(a) of the Homeowner Protection Act (the “Act”) and s. 20.1(2)(b) of the Homeowner Protection Act Regulation (the “Regulation”), 1296553 BC Ltd. (“1296553”) and Davinder Pal Bajwa (“Bajwa”) were issued a monetary penalty, jointly and severely, in the single amount of $4,500. This Monetary Penalty was issued for the following reasons:

  • 1296553 and Bajwa, contrary to s. 14(1) of the Act, conducted the business of a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) in relation to a new home in Lake Cowichan, BC (the “New Home”) by entering into a Purchase and Sale Agreement for the New Home and the property on or about April 4, 2025, and subsequently completing that sale, despite neither 1296553 nor Bajwa being a BCH LRB; and
  • The contravention of the Act by 1296553 and Bajwa makes 1296553 and Bajwa subject to a monetary penalty pursuant to s. 28.3(1)(a) of the Act and s. 20.1(2)(b) of the Regulation.
