Alex King Charn Chang (“Chang”) and Tricon Pacific Contracting Ltd. (“TPCL”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built or caused to have built two new homes in Vancouver, B.C. (the “New Homes”), during the period of, or about, April 2010 and March 2012, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and without any of the New Homes being registered for coverage by home warranty insurance provided by a warranty provider. On November 20, 2013, Compliance Order 13-0032 (the “CO”) was issued by the HPO to Alex Chang and Jack Dale Anaka (“Anaka”) directing that they become an HPO LRB and enrol the New Homes in a policy of home warranty insurance. The CO was amended by removing Anaka from the CO as a liable party, amending Alex Chang to Alex King Charn Chang, adding TPCL to the Amended Compliance Order 13-0031-1 (the “ACO”) as a liable party, modifying the orders contained in the CO and the date for compliance of those orders. On May 28, 2014, the ACO was issued by the HPO to Chang and TPCL, directing that Chang and TPCL:
- immediately apply for and become an HPO LRB pursuant to section 14(1) of the Act, and
- register the New Homes for coverage by home warranty insurance provided by a warranty provider pursuant to section 22(1) of the Act; or
- provide the HPO with proof that each of the New Homes is enrolled in a policy of home warranty insurance pursuant to section 22 of the Act.
Chang and TPCL were directed to comply with the ACO by July 4, 2014.
