Animark Holdings Ltd. (“AHL”) and Marko Mrsic (“Mrsic”) constructed a new home in Vancouver, BC (the “New Home”), between the period of, or about, October 16, 2018, and January 10, 2024. Although AHL was approved as a BC Housing (“BCH”) Licensed Residential Builder (“LRB”)(37378) since July 10, 2013, and obtained a commitment from an approved home warranty insurer on September 5, 2017, to provide home warranty insurance (“HWI”) on the New Home as required by the Homeowner Protection Act (the “Act”) and the Homeowner Protection Act Regulation, the New Home was de-enrolled from HWI coverage by the home warranty insurer on January 10, 2024, contrary to section 22(1) of the Act. On February 29, 2024, BCH issued Compliance Order 24-0006 to AHL and Mrsic directing that AHL and Mrsic:
- immediately register the New Home for coverage by HWI provided by a warranty provider pursuant to section 22(1) of the Act; or
- provide BCH Compliance Department with proof that the New Home is currently enrolled in a policy of HWI pursuant to section 22(1) of the Act.
AHL and Mrsic were ordered to comply with Compliance Order 24-0006 by March 29, 2024. Complied.
