Ardent Construction Ltd. (“Ardent”) and Robert George Wighton (“R. Wighton), contrary to section 22(1) of the Homeowner Protection Act (the “Act”), built a new home in Port McNeill, BC (the “New Home”), between April 2008 and February 2009. Although Ardent and R. Wighton were approved as a Homeowner Protection Office (“HPO”) Licensed Residential Builder (28347) during this period, Ardent and R. Wighton constructed the New Home without the New Home being registered for coverage by home warranty insurance provided by a warranty provider. On April 21, 2016, the HPO issued Compliance Order 16-0021 to Ardent and R. Wighton directing that Ardent and R. Wighton:
- Immediately register the New Home for coverage by home warranty insurance provided by a warranty provider pursuant to section 22(1) of the Act.
Ardent and R. Wighton were directed to comply with Compliance Order 16-0021 by May 27, 2016.
