Burkard Developments Ltd. (“BDL”) and David John Burkard (“Burkard”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder without a valid BC Housing (“BCH”) Residential Builder Licence between the period of, or about, September 9, 2024, and June 16, 2025, with respect to a new home in Port Renfrew, BC (the “New Home”). On June 16, 2025, BCH issued Compliance Order 25-0004 to BDL and Burkard directing that BDL and Burkard:

  • immediately cease carrying on the business of a residential builder as defined in the Act; and
  • immediately either:
    1. become a BCH Licensed Residential Builder pursuant to section 14(1) of the Act as a general contractor;
    2. hire a person who holds a residential builder licence as a general contractor to construct the New Home; or
    3. if Burkard meets the eligibility requirements, Burkard may apply for, and be issued, an Owner Builder Authorization for the New Home on the property pursuant to section 20(1) of the Act and section 4.1(2) of the Homeowner Protection Act Regulation.

BDL and Burkard were ordered to comply with Compliance Order 25-0004 by August 1, 2025.
