Monetary Penalty
Issue Date
On December 16, 2025, pursuant to s. 28.3(1)(b) of the Homeowner Protection Act (the “Act”), Burkard Developments Ltd. (“BDL”) and David John Burkard (“Burkard”) were issued a monetary penalty, jointly and severally, in a daily amount of $250, to a maximum of $7,500, for each day that passes until the demands contained in Compliance Order 25-0004(the “CO”) have been satisfied. This Monetary Penalty was issued for the following reasons:
- BDL and Burkard contravened s. 14(1) of the Act regarding a new home in Port Renfrew, BC (the “New Home”);
- The contravention of the Act by BDL and Burkard was the subject of the CO issued by BC Housing (“BCH”) on June 16, 2025. The date for complying with the CO was August 1, 2025;
- The CO directed BDL and Burkard to ensure all construction activities cease on the New Home; and immediately either become a BCH Licensed Residential Builder pursuant to section 14(1) of the Act, hire a person who holds a residential builder licence as a general contractor to construct the New Home, or if eligible, apply for and be issued an Owner Builder Authorization for the New Home pursuant to section 20(1) of the Act and section 4.1(2) of the Homeowner Protection Act Regulation; and
- BDL and Burkard failed to comply with any of the orders contained in the CO by the requested compliance date.
