Caden Douglas Young (“C. Young”), Sybille Brigitte Young (“S. Young”), and David Douglas Young (“D. Young”) (together, “the Youngs”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), carried on the business of a residential builder without a BC Housing (“BCH”) Residential Builder Licence between approximately July 22, 2025, and July 15, 2026, in connection with the construction of a new home in Burnaby, BC (the “New Home”). On June 15, 2026, the New Home was de-enrolled from home warranty insurance (“HWI”). The Youngs continued construction of the New Home after its de-enrollment and without ensuring that it was registered for coverage by HWI provided by a warranty provider, contrary to section 22(1) of the Act. On July 15, 2026, BCH issued Compliance Order 26-0013 (the “CO”) to the Youngs directing that the Youngs:
- immediately cease carrying on the business of a residential builder as defined in the Act; and
- immediately either:
- become a BCH Licensed Residential Builder (“LRB”) pursuant to section 14(1) of the Act, and register the New Home for coverage by HWI provided by a warranty provider pursuant to section 22(1) of the Act;
- retain a LRB to enroll the New Home in HWI and complete construction of the New Home; or
- if eligible, C. Young, S. Young, or D. Young may apply for, and be issued, an Owner Builder Authorization for the New Home pursuant to section 20(1) of the Act and section 4.1(2) of the Homeowner Protection Act Regulation.
The Youngs were ordered to comply with Compliance Order 26-0013 by August 21, 2026.
