On January 29, 2025, pursuant to s. 28.3(1)(b) of the Homeowner Protection Act (the “Act”), Donna Simone Marie Revet (“Revet”) and Joseph William Hewitt (“Hewitt”) were issued a monetary penalty, jointly and severally, in a daily amount of $234, to a maximum of $7,000, for each day that passes until the demands contained in the Amended Compliance Order 19-0010-1 (the “ACO”) have been satisfied. This Monetary Penalty was issued for the following reasons:

  • Revet and Hewitt, contrary to sections 14(1) and 22(1) of the Act, commenced construction on two new homes in Cluculz Lake, BC (the “New Homes”) prior to March 18, 2016, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without each of the New Homes being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider;
  • The contraventions of the Act by Revet and Hewitt were the subject of the ACO issued by BCH on October 21, 2020. The date for complying with the ACO was December 18, 2020;
  • The ACO directed Revet and Hewitt to immediately cease all construction activities on the New Homes; and immediately either apply for and become a BCH LRB pursuant to section 14(1) of the Act and register each of the New Homes for coverage by HWI pursuant to section 22(1) of the Act, provide proof that each of the New Homes is enrolled in a policy of HWI pursuant to section 22(1) of the Act, if eligible, apply for and be issued an Owner Builder Authorization for each of the New Homes, or provide BCH Compliance Department evidence that each of the New Homes no longer meets the definition of a “new home” as defined under the Act; and    
  • The Revet and Hewitt failed to comply with any of the orders contained in the ACO by the requested compliance date.
