Edward West Luxury Homes Inc. (“EWLH”) and Sebastian Motora (“Motora”) constructed a new home in Lake Country, BC (the “New Home”), between the period of, or about, February 3, 2022, and October 28, 2024. Although EWLH has been approved as a BC Housing (“BCH”) Licensed Residential Builder (“LRB”)(46401) since August 15, 2019, and obtained a commitment from an approved home warranty insurer on February 3, 2022, to provide home warranty insurance (“HWI”) on the New Home as required by the Homeowner Protection Act (the “Act”) and the Homeowner Protection Act Regulation, the New Home was de-enrolled from HWI coverage by the home warranty insurer on October 28, 2024, contrary to section 22(1) of the Act. On February 12, 2025, BCH issued Compliance Order 25-0008 to EWLH and Motora directing that EWLH and Motora:
- Immediately:
- register the New Home for coverage by HWI provided by a warranty provider pursuant to section 22(1) of the Act; or
- provide BCH Compliance Department with proof that the New Home is currently enrolled in a policy of HWI pursuant to section 22(1) of the Act.
EWLH and Motora were ordered to comply with Compliance Order 25-0008 by March 21, 2025.
