Monetary Penalty
Issue Date

On August 11, 2025, pursuant to s. 28.3(1)(b) of the Homeowner Protection Act (the “Act”), Edward West Luxury Homes Inc. (“EWLH”) and Sebastian Motora (“Motora”) were issued a monetary penalty, jointly and severally, in a daily amount of $268, to a maximum of $8,050, for each day that passes until the demands contained in Compliance Order 25-0008 (the “CO”) have been satisfied. This Monetary Penalty was issued for the following reasons:

  • EWLH and Motora contravened s. 22(1) of the Act regarding a new home in Lake Country, BC (the “New Home”);
  • The contravention of the Act by EWLH and Motora was the subject of the CO issued by BCH on February 12, 2025. The date for complying with the CO was March 21, 2025;
  • The CO directed EWLH and Motora to immediately register the New Home in a policy of Home Warranty Insurance (“HWI”) provided by a warranty provider pursuant to section 22(1) of the Act, or provide BCH Compliance Department with proof that the New Home is enrolled in a policy of HWI pursuant to section 22 of the Act; and  
  • EWLH and Motora failed to comply with either of the orders contained in the CO by the requested compliance date.
