Flawless Homes Ltd. (“FHL”) and Stefan Bullert (“Bullert”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), although FHL and Bullert were approved as Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) (38420) between July 10, 2014, and July 31, 2015, built a new home in Fort St. John, BC (the “New Home”), between the period of, or about, March 20, 2015, and September 24, 2015, without the New Home being covered by a policy of home warranty insurance and without a valid HPO Residential Builder Licence since HPO LRB 38420 expired on July 31, 2015. On December 3, 2015, the HPO issued Compliance Order 15-0034 to FHL and Bullert directing that FHL and Bullert:
- Immediately apply for and become an HPO LRB pursuant to section 14(1) of the Act and register the New Home for coverage by home warranty insurance provided by a warranty provider pursuant to section 22(1) of the Act.
FHL and Bullert were directed to comply with Compliance Order 15-0034 by January 11, 2016.
