G P Home Developments Limited (“GPHD”) and Tejpal Singh Kailay (“Kailay”) constructed a new home in Coquitlam, BC (the “New Home”), between the period of, or about, March 25, 2022, and September 18, 2024. Although GPHD has been approved as a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) 35374 since January 13, 2012, and obtained a commitment from an approved home warranty insurer on March 25, 2022, to provide home warranty insurance (“HWI”) on the New Home as required by the Homeowner Protection Act (the “Act”) and the Homeowner Protection Act Regulation (the “Regulation”), the New Home was de-enrolled from HWI coverage by the home warranty insurer on May 15, 2025, contrary to section 22(1) of the Act. On September 3, 2025, BCH issued Compliance Order 25-0019 to GPHD and Kailay directing that GPHD and Kailay:
- Immediately either:
- Register the New Home for coverage by HWI provided by a warranty provider pursuant to section 22(1) of the Act; or
- Provide BCH Compliance Department with proof that the New Home is enrolled in a policy of HWI pursuant to section 22 of the Act.
GPHD and Kailay were ordered to comply with Compliance Order 25-0019 by October 3, 2025.
