Gallery Homes Ltd. (“GHL”) and Blair Edward Gunn (“Gunn”) constructed a new home in Surrey, B.C. (the “New Home”), between the period of, or about, October 19, 2012, and May 7, 2014. Although GHL held a valid Homeowner Protection Office (“HPO”) Residential Builder Licence (#20548), and obtained a commitment from an approved home warranty insurer on March 16, 2012, to provide home warranty insurance on the New Home as required by the Homeowner Protection Act (the “Act”) and the Homeowner Protection Act Regulation, the New Home was de-enrolled from home warranty insurance coverage by GHL on March 2, 2014, contrary to section 22(1) of the Act. On February 4, 2015, Compliance Order 15-0003 was issued by the HPO to GHL and Gunn, directing that GHL and Gunn
- register the New Home for coverage by home warranty insurance provided by a warranty provider pursuant to section 22(1) of the Act.
GHL and Gunn were directed to comply with Compliance Order 15-0003 by February 27, 2015. Complied.
