Grandview Bench Properties Ltd. (“GBP”) and Sun Kim (“Kim”), contrary to section 22(1.1)(b) of the Homeowner Protection Act (the “Act”), offered and marketed for sale 3 new homes on a property in Tappen, BC (collectively, the “New Homes”), within 10 years from the date the New Homes were first ready for occupancy, and without any of the New Homes being registered for coverage by home warranty insurance provided by a warranty provider. On August 29, 2025, BC Housing (“BCH’) issued Compliance Order 25-0020 to GBP and Kim directing that GBP and Kim:
- immediately cease the offering for sale, marketing, completion of any Purchase/Sale Agreement that may already be in place, or may come into place, and/or actual sale of the New Homes and the property (the “Property);
- provide to BCH Compliance Department a completed and signed Listing Cancellation Form for the Property; and
- until such time as each of the New Homes is in compliance with the Act and the Homeowner Protection Act Regulation (the “Regulation”), any offer to sell any of the New Homes, or actual transfer of title of the Property by GBP, Kim or anyone else, would not be legally permissible under the Act and Regulation unless permission to sell the New Homes and the Property has been granted by the Registrar under section 22(1.2) of the Act.
GBP and Kim were ordered to comply with Compliance Order 25-0020 by September 12, 2025.
