Harpreet Kaur Saprai (“H. Saprai”) and Amarbir Singh Saprai (“A. Saprai”) (together, the “Saprais”) contrary to section 21(2)(a) of the Homeowner Protection Act (the “Act”), regarding a new home in Abbotsford, B.C., (the “New Home”), for which an Owner Builder Authorization had been issued, offered the New Home for sale between the dates of, on or before, July 22, 2011, and December 2011, without first being issued a Disclosure Notice from the HPO for the New Home. On February 23, 2012, the Homeowner Protection Office issued Compliance Order 12-0009 to the Saprais ordering them to immediately cease the offering for sale, marketing, completion of any Purchase/Sale Agreement that may already be in place or may come into place and/or actual sale of the New Home. The Saprais were directed to comply with Compliance Order 12-0009 by March 9, 2012.
