Incircle Projects Ltd. (“IPL”) and King Yeung Luk (“Luk”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder without a valid BC Housing (“BCH”) Residential Builder Licence between the period of, or about, September 9, 2020, and February 9, 2021, regarding three new homes in Richmond, BC (the “New Homes”). On February 9, 2021, BCH issued Compliance Order 21-0005 to IPL and Luk directing that IPL and Luk:
- cease construction activities on the New Homes;
- cease carrying on the business of a residential builder as defined in the Act; and
- apply for and become a BCH Licensed Residential Builder pursuant to section 14(1) of the Act.
IPL and Luk were directed to comply with Compliance Order 21-0005 by March 19, 2021.
