Justin Linford (“J. Linford”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), constructed a new home in Charlie Lake, BC (the “New Home”), sometime prior to August 2018 without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider. Additionally, contrary to section 22(1.1) of the Act, J. Linford sold the New Home on or about June 5, 2024, without the New Home being registered for HWI coverage. On June 12, 2026, BCH issued Compliance Order 26-0009 to J. Linford directing that J. Linford:
- immediately complete the application for an Owner Builder Authorization and obtain such authorization for the New Home, if eligible;
- apply for and become a BCH LRB pursuant to section 14(1) of the Act, and register the New Home for HWI coverage pursuant to section 22(1) of the Act; or
- provide BCH Compliance Department with proof that the New Home is enrolled in a policy of HWI in accordance with section 22 of the Act.
J. Linford was ordered to comply with Compliance Order 26-0009 by July 10, 2026.
