On February 12, 2020, pursuant to s. 28.3(1)(a) of the Homeowner Protection Act (the “Act”) and s. 20.1(2)(b) of the Homeowner Protection Act Regulation (the “Regulations”), K.O.A.D. Construction Ltd. (“KCL”), Clifford Leslie Danny Henzie (“Henzie”) and Valerie Ann Blair (“Blair”) were issued a monetary penalty, jointly and severely, in a single amount of $7,500. This Monetary Penalty was issued for the following reasons:
- KCL, Henzie and Blair, contrary to s. 14(1) of the Act, conducted the business of a residential builder with respect to a new home in Lake Country, BC, between the period of, or about, October 19, 2018 and December 16, 2019, without any of them being a BC Housing Licensed Residential Builder; and
- The contravention of the Act by KCL, Henzie and Blair makes KCL, Henzie and Blair subject to a monetary penalty pursuant to s. 28.3(1)(a) of the Act and s. 20.1(2)(b) of the Regulation
