Mountain West Construction Ltd. (“MWCL”), Donald Neufeldt (“D. Neufeldt”), and Elly Neufeldt (“E. Neufeldt”) constructed a new home in Langley, BC (the “New Home”) during the period of, or about, June 22, 2015, and January 7, 2016. Although MWCL has been a BC Housing (“BCH”) Licensed Residential Builder (21745) since April 18, 2000, and obtained a commitment from an approved home warranty insurer on June 18, 2015, to provide home warranty insurance on the New Home as required by the Homeowner Protection Act (the “Act”) and the Homeowner Protection Act Regulation, the New Home was de-enrolled from home warranty insurance coverage by the home warranty insurer on January 7, 2016, contrary to section 22(1) of the Act. On June 13, 2017, BCH issued Compliance Order 17-0007 to MWCL, D. Neufeldt, and E. Neufeldt directing MWCL, D. Neufeldt and E. Neufeldt:
- immediately register the New Home for coverage by home warranty insurance provided by a warranty provider pursuant to section 22(1) of the Act.
MWCL, D. Neufeldt and E. Neufeldt were directed to comply with Compliance Order 17-0007 by July 7, 2017. Complied.
