Nabob Homes Ltd. (“Nabob”), 0852845 B.C. Ltd. (“0852845”), and Manjit Rai (“M. Rai”), constructed a new home in Maple Ridge, B.C. (the “New Home”), between the dates of April 29, 2011, and February 14, 2014. Although Nabob had been a Homeowner Protection Office (“HPO”) Licensed Residential Builder (29791) since July 23, 2007, and obtained a commitment from an approved home warranty insurer on August 25, 2010, to provide home warranty insurance on the New Home as required by the Homeowner Protection Act (the “Act”) and the Homeowner Protection Act Regulation, the New Home was de-enrolled from home warranty insurance coverage by the home warranty insurer on February 17, 2014, contrary to section 22(1) of the Act.
