Narinder Lally (“N. Lally”) and Gaurav Lally (“G. Lally”) (together, “the Lallys”) commenced and continued construction on a new home in Surrey, B.C. (the “New Home”), between the period of, or about, January 18, 2018, and June 11, 2018. Although the Lallys have been persons in control of, and approved as, BC Housing (“BCH”) Licensed Residential Builder 39841 since March 9, 2015, the New Home has never been registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider since construction commenced on the New Home, on or about, January 18, 2018, contrary to section 22(1) of the Homeowner Protection Act (the “Act”). On June 11, 2018, BCH issued Compliance Order 18-0041 to the Lallys directing that the Lallys:
- immediately cease all construction activities on the New Home; and
- immediately register the New Home for coverage by HWI provided by a warranty provider pursuant to section 22(1) of the Act.
N. Lally and G. Lally were ordered to comply with Compliance Order 18-0041 by June 22, 2018. Complied.
