Norman Cowan (“Cowan”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), resumed construction on a new home in Duncan, BC (the “New Home”), sometime between November 1, 2021 and January 25, 2022, after the New Home was de-enrolled from home warranty insurance coverage on October 7, 2021, without being a BC Housing (“BCH”) Licensed Residential Builder and without the New Home being registered for coverage by home warranty insurance provided by a warranty provider. On February 23, 2022, BCH issued Compliance Order 22-0003 to Cowan directing that Cowan:

  • cease carrying on the business of a residential builder as defined in the Act and cease construction activities on the New Home.

Cowan was ordered to comply with Compliance Order 22-0003 by April 1, 2022.
