On May 2, 2014, pursuant to s. 28.3(1)(c) of the Homeowner Protection Act (the “Act”), Northern Woodworker Ltd. (“NWL”) and Ivan Kortchevich (“Kortchevich”), were issued a monetary penalty in the single amount of $4,950. This Monetary Penalty was issued for the following reasons:
- NWL and Kortchevich contravened s. 14(1) and s. 22(1) of the Act regarding a new home in Fort Nelson, B.C. (the “New Home”), during the period of, or about, April 5, 2004, and October 21, 2008;
- On June 15, 2010, the HPO placed a conditional status on HPO Licence 32515 requiring NWL and Kortchevick to enrol the New Home in a policy of home warranty insurance within 30 days. Kortchevich and NWL failed to meet the condition of HPO Licence 32515 by the requested date;
- On November 6, 2012, the HPO placed a conditional status on HPO Licence 36472 requiring NWL and Kortchevich to enrol the New Home in a policy of home warranty insurance within 30 days. Kortchevich and NWL failed to meet the condition of HPO Licence 36472 by the requested date; and
NWL and Kortchevich failed to comply with the conditions of HPO Licence 32515 and HPO Licence 36472 by the requested dates.
