Pawitter Basra (“Basra”) constructed two new homes in Vancouver, BC (the “New Homes”), during the period of, or about, February 23, 2015, and November 10, 2017. Although Basra has been a BC Housing (“BCH”) Licensed Residential Builder (38543) since May 22, 2014, and obtained a commitment from an approved home warranty insurer on February 23, 2015, to provide home warranty insurance (“HWI”) on each of the New Homes as required by the Homeowner Protection Act (the “Act”) and the Homeowner Protection Act Regulation, the New Homes were de-enrolled from HWI coverage by the home warranty insurer on November 10, 2017, contrary to section 22(1) of the Act. On March 14, 2018, BCH issued Compliance Order 18-0021 to Basra directing that Basra:
- immediately cease all construction activities on the New Homes; and
- immediately either:
- register each of the New Homes for coverage by HWI provided by a warranty provider pursuant to section 22(1) of the Act; or
- provide BCH Compliance Department with proof that the New Homes are currently enrolled in a policy of HWI pursuant to section 22 of the Act.
Basra was ordered to comply with Compliance Order 18-0021 by April 13, 2018.
