PD Moore Homes Inc. (“PDMH”), Gurdish (Deejay) Johal (“Johal”), and Perdip Singh Moore (“Moore”) constructed a new home in Burnaby, BC (the “New Home”), during the period of, or about, February 25, 2016, and November 15, 2016. Although PDMH has been a BC Housing (“BCH”) Licensed Residential Builder (36509) since November 14, 2012, and obtained a commitment from an approved home warranty insurer on February 22, 2016, to provide home warranty insurance (“HWI”) on the New Home as required by the Homeowner Protection Act (the “Act”) and the Homeowner Protection Act Regulation, the New Home was de-enrolled from HWI coverage by the home warranty insurer at the request of PDMH on February 17, 2017, contrary to section 22(1) of the Act. On March 28, 2017, BCH issued Compliance Order 17-0008 to PDMH, Johal, and Moore directing that PDMH, Johal and Moore:
- immediately register the New Home for coverage by HWI provided by a warranty provider pursuant to section 22(1) of the Act; or
- provide BCH Compliance Department with proof that the New Home is currently enrolled in a policy of HWI pursuant to section 22(1) of the Act.
PDMH, Johal and Moore were directed to comply with Compliance Order 17-0008 by April 21, 2017.
