Sterling Pacific Developments Inc. (“SPD”) and David William Harper (“D. Harper”) constructed a new home in West Vancouver, B.C. (the “New Home”), during the period of, or about, May 9, 2016, and March 15, 2017. Although SPD has been a BC Housing (“BCH”) Licensed Residential Builder (21409) since February 20, 2003, contrary to section 22(1) of the Homeowner Protection Act (the “Act”), the New Home was not registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider. On May 16, 2017, BCH issued Compliance Order 17-0012 to SPD and D. Harper directing that SPD and D. Harper:
- immediately register the New Home for coverage by HWI provided by a warranty provider pursuant to section 22(1) of the Act;
- provide BCH Compliance Department with proof that the New Home is currently enrolled in a policy of HWI pursuant to section 22(1) of the Act.
SPD and D. Harper were directed to comply with Compliance Order 17-0012 by June 9, 2017.
