Timothy Mascarenhas (“Mascarenhas”) and Steelewood Builders Inc. (“SBI”) constructed a new home in Blind Bay, B.C. (the “New Home”), between the period of, or about, January 14, 2009, and January 23, 2012. Although SBI has been a Homeowner Protection Office (“HPO”) Licensed Residential Builder (29645) since October 22, 2007, and obtained a commitment from an approved home warranty insurer on January 14, 2009, to provide home warranty insurance on the New Home as required by the Homeowner Protection Act (the “Act”) and the Homeowner Protection Act Regulation, the New Home was de-enrolled from home warranty insurance coverage by the home warranty insurer at the request of SBI on August 14, 2014, contrary to section 22(1) of the Act. On September 2, 2014, Compliance Order 14-0053 was issued by the HPO to Mascarenhas and SBI directing that Mascarenhas and SBI:
- immediately register the New Home for coverage by home warranty insurance provided by a warranty provider pursuant to section 22(1) of the Act.
Mascarenhas and SBI were directed to comply with Compliance Order 14-0053 by October 3, 2014.
