Trafalgar Homes Ltd. (“THL”) and Byron James Schofield (“Schofield”) constructed a new home on Mayne Island, B.C. (the “New Home”), during the period of, or about, March 23, 2013, and July 15, 2015. Although THL has been a Homeowner Protection Office (“HPO”) Licensed Residential Builder (31758) since June 11, 2009, and obtained a commitment from an approved home warranty insurer on May 23, 2013, to provide home warranty insurance on the New Home as required by the Homeowner Protection Act (the “Act”) and the Homeowner Protection Act Regulation, the New Home was de-enrolled from home warranty insurance coverage by the home warranty insurer on July 15, 2015, contrary to section 22(1) of the Act. On January 26, 2016, the HPO issued Compliance Order 16-0005 to THL and Schofield directing that THL and Schofield:
- immediately register the New Home for coverage by home warranty insurance provided by a warranty provider pursuant to section 22(1) of the Act.
THL and Schofield were directed to comply with Compliance Order 16-0005 by March 4, 2016. Complied.
