Woojung Chung (“W. Chung”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), built or caused to have built a new home in West Vancouver, BC (the “New Home”), during the period of, or about, June 2, 2017, and January 17, 2020, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”), and without the New Home being registered for coverage by home warranty insurance (“HWI”) since the New Home was de-enrolled from HWI coverage on June 5, 2018, contrary to section 22(1) of the Act. On January 17, 2020, BCH issued Compliance Order 20-0003 to W. Chung. On November 12, 2020, BCH issued Amended Compliance Order 20-0003-1 to W. Chung changing the requested compliance date and directing that W. Chung:
- immediately cease all construction activity on the New Home until such time as the New Home is in compliance with the Act; and
- immediately either apply for and become a BCH Licensed Residential Builder pursuant to section 14(1) of the Act and register the New Home for coverage by HWI provided by a warranty provider pursuant to section 22(1) of the Act; or provide BCH Compliance Department with proof that the New Home is enrolled in a policy of HWI pursuant to section 22(1) of the Act.
W. Chung was directed to comply with Amended Compliance Order 20-0003-1 by December 11, 2020.
