Dema Developments Ltd. (“DDL”), Sunny Singh Deol (“Deol”), Sukhvinder Kaur Mandair (“S.K. Mandair”), and Sachan Mandair (“S. Mandair”), contrary to section 22(1) of the Homeowner Protection Act (the “Act”), constructed, or caused to have constructed, two new homes in Mission, BC (collectively, the “New Homes”), without each of the New Homes being registered for coverage by home warranty insurance provided by a warranty provider. On June 14, 2017, BC Housing (“BCH”) issued Compliance Order 17-0021 to DDL, Deol, S.K. Mandair, and S. Mandair directing that DDL, Deol, S.K. Mandair, and S. Mandair:
- ensure DDL’s Residential Builder Licence (42013) remains in approved status, and immediately register the New Homes for coverage by home warranty insurance (“HWI”) provided by a warranty provider, and ensure that a policy of HWI is issued for each of the New Homes pursuant to section 22(1) of the Act; or
- provide BCH Compliance Department with proof that each of the New Homes is currently enrolled in a policy of HWI pursuant to section 22(1) of the Act.
DDL, Deol, S.K. Mandair, and S. Mandair were directed to comply with Compliance Order 17-0021 by July 14, 2017.
