Andrea Hook (“A. Hook”), Lawrence Hook (“L. Hook”) and Hook & Hook Renovations and Design Inc. (“HHRD”), contrary to section 14(5)(b) of the Homeowner Protection Act (the “Act”), published information implying and suggesting that either A. Hook, L. Hook or HHRD is a Licensed Residential Builder (“LRB”), and contrary to section 14(1) of the Act, conducted the business of a residential builder without being a BC Housing (“BCH”) LRB between the period of, or about, September 5, 2019 and July 22, 2020, regarding a new home in North Saanich, BC (the “New Home”). On July 22, 2020, BCH issued Compliance Order 20-0019 to A. Hook, L. Hook and HHRD, directing that A. Hook, L. Hook and HHRD:
- cease carrying on the business of a residential builder as defined in the Act, and cease construction activities on the New Home;
- immediately cease all signage, marketing and other publications that imply, suggest or hold out in any manner that either A. Hook, L. Hook or HHRD is a LRB; and
- immediately apply for and become a BCH LRB pursuant to section 14(1) of the Act.
A. Hook, L. Hook and HHRD were directed to comply with Compliance Order 20-0019 by August 28, 2020.
