BV Developments Management Inc. (“BV Developments”) and Jun Qi (“Qi”), contrary to section 4.04 of the Homeowner Protection Act Regulation (the “Regulation”), commenced construction on a Part 9 residential building in Langford, BC (the “New Home”) sometime between March 2021 and October 2021 while holding a BC Housing (“BCH”) residential builder license as a developer only and without either qualifying as a general contractor with BCH or hiring a person who holds a residential builder license as a general contractor for the construction of the New Home. On March 23, 2022, BCH issued Compliance Order 22-0006 to BV Developments and Qi directing that BV Developments and Qi:
Immediately cease all construction activities on the New Home, and immediately cease acting in the capacity of a general contractor, until such time that either:
- BV Developments and Qi can provide BCH with evidence that they have contracted with a person who holds a residential builder license as a general contractor with BCH for the construction of the New Home, or
- BV Developments or Qi holds a residential builder license as a general contractor.
