On February 24, 2010, pursuant to s. 28.3(1)(a) of the Homeowner Protection Act, (the “Act”) and s. 20.1(2)(b) of the Homeowner Protection Act Regulation, (the “Regulations”), Eelake Liau (“Liau”) and 0720958 BC Ltd. (“0720958”), were issued a monetary penalty, jointly and severally, in the single amount of $1,000. This monetary penalty was issued for the following reasons:
- Liau and 0720958, contrary to s. 14(1) and 22(1) of the Act, respectively, built a new home in Vancouver, B.C., (the “New Home”) without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder and without the New Home being covered by home warranty insurance. The contraventions of the Act by Liau and 0720958 are the subject of Compliance Order 08-0020 (“CO”) issued by the HPO on June 25, 2008, and Amended Compliance Order 08-0020-1 (“ACO”) issued by the HPO on April 23, 2009; and
- Liau and 0720958 failed to comply with the CO and the ACO by the requested compliance dates.
