On January 30, 2024, pursuant to s. 28.3(1)(a) of the Homeowner Protection Act (the “Act”) and s. 20.1(2)(b) of the Homeowner Protection Act Regulation (the “Regulation”), Five Land Construction Ltd. (“FLC”) and Davinder Pal Singh Bajwa (“Bajwa”) were issued a monetary penalty, jointly and severely, in the single amount of $4,200. This Monetary Penalty was issued for the following reasons:
- FLC and Bajwa, contrary to s. 14(1) of the Act, conducted the business of a residential builder with respect to a new home in Lake Cowichan, BC, between the period of, or about, May 2022 and September 2023, without any of them being a BC Housing Licensed Residential Builder; and
- The contravention of the Act by FLC and Bajwa makes FLC and Bajwa subject to a monetary penalty pursuant to s. 28.3(1)(a) of the Act and s. 20.1(2)(b) of the Regulation.
