Kenneth Trevor Joel Oliver (“K. Oliver”) contravened section 22(1) of the Homeowner Protection Act (the “Act”) regarding a new home in Kelowna, B.C. (the “New Home”), during the period of, or about, August 2016 and November 2016. Although K. Oliver has been a BC Housing (“BCH”) Licensed Residential Builder (41311) since January 21, 2016, K. Oliver commenced and continued construction on the New Home without the New Home being registered for coverage by home warranty insurance provided by a warranty provider. On January 16, 2017, BCH issued Compliance Order 17-0002 to K. Oliver directing that K. Oliver:
- immediately register the New Home for coverage by home warranty insurance provided by a warranty provider pursuant to section 22(1) of the Act; or
- provide BCH Compliance Department with proof that the New Home is being built by a Licensed Residential Builder and is enrolled in a policy of home warranty insurance pursuant to section 22(1) of the Act.
K.Oliver was directed to comply with Compliance Order 17-0002 by January 31, 2017.
