Kyle Walker Construction Inc. (“KWC”) and Kyle Walker (“Walker”), contrary to section 14(5)(b) of the Homeowner Protection Act (the “Act”), published information implying and suggesting that KWC and/or Walker is a licensed residential builder during the period of, or about, March 22, 2022, and January 30, 2023, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”). On January 30, 2023, BCH issued Compliance Order 23-0003 to KWC and Walker directing that KWC and Walker:
- immediately cease all signage, marketing, and other publications that imply, suggest, or hold out in any manner that either KWC or Walker is a licensed residential builder; or
- immediately become a BCH LRB pursuant to section 14 of the Act.
KWC and Walker were ordered to comply with Compliance Order 23-0003 by March 1, 2023.
