Mark Rodolph Gaudreault (“Gaudreault”) and Milagros Clemencia Rivera Cuzco (“Cuzco”), contrary to section 22(1.1)(b) of the Homeowner Protection Act (the “Act”), sold a new home in Blind Bay, BC (the “New Home”) on, or about, November 27, 2020, within 10 years from the date the New Home was ready for occupancy, without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider. On November 30, 2021, BC Housing (“BCH”) issued Compliance Order 21-0007 to Gaudreault and Cuzco directing that Gaudreault and Cuzco immediately either:
- become a Licence Residential Builder pursuant to section 14(1) of the Act, and register the New Home for coverage by HWI provided by a warranty provider pursuant to section 22(1) of the Act; or
- provide BCH Compliance Department with proof that the New Home is enrolled in a policy of HWI pursuant to section 22 of the Act.
Gaudreault and Cuzco were ordered to comply with Compliance Order 21-0007 by January 13, 2022.
