Palwinder Singh Gill (“Gill”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder between the period of October 2014 and March 2015, regarding a new home development in Surrey, B.C. (the “New Home”), without a valid HPO Residential Builder Licence. On March 27, 2015, the HPO issued Compliance Order 15-0016 (“CO”) to Gill directing that Gill immediately:

  • cease carrying on the business of a residential builder as defined in the Act. More specifically, cease engaging in, arranging for or managing the construction of any new home, including such activities as receiving a building permit(s) for new home construction, commencing construction on a new home, continuing construction of a new home, advertising as a residential builder, offering to sell or selling a new home, or contracting, or otherwise agreeing, to build a new home for an owner or developer;
  • apply for and become an HPO Licensed Residential Builder pursuant to section 14(1) of the Act; and
  • cease the activities noted in Item 1 above, until such time as Gill is issued a Residential Builder Licence by the HPO pursuant to section 14 of the Act.

Gill was directed to comply with the CO by April 17, 2015. Complied.
