On February 6, 2024, pursuant to s. 28.3(1)(a) of the Homeowner Protection Act (the “Act”) and s. 20.1(2)(b) of the Homeowner Protection Act Regulation (the “Regulation”), S. Meredith Construction Inc. (“SMC”) and Scott William Meredith (“Meredith”) were issued a monetary penalty, jointly and severely, in the single amount of $2,700. This Monetary Penalty was issued for the following reasons:
- SMC and Meredith, contrary to s. 14(1) of the Act, conducted the business of a residential builder with respect to three new homes in Courtenay, BC, between the period of, or about, February 2021 and August 2023, without any of them being a BC Housing Licensed Residential Builder; and
- The contravention of the Act by SMC and Meredith makes SMC and Meredith subject to a monetary penalty pursuant to s. 28.3(1)(a) of the Act and s. 20.1(2)(b) of the Regulation.
