On May 10, 2016, pursuant to s. 28.3(1)(a) of the Homeowner Protection Act (the “Act”) and s. 20.1(2)(b) of the Homeowner Protection Act Regulation (the “Regulations”), Steel Dragon Enterprises Ltd. (“SDEL”) and Clayton Tomandl (“C. Tomandl”), were issued a monetary penalty, jointly and severely, in the single amount of $6,600. This Monetary Penalty was issued for the following reasons:
- SDEL and C. Tomandl, contrary to s. 14(1) of the Act, conducted the business of a residential builder with respect to a new home located in Surrey, B.C., without being a Licensed Residential Builder; and
- The contravention of the Act by SDEL and C. Tomandl makes SDEL and C. Tomandl subject to a monetary penalty pursuant to s. 28.3(1)(a) of the Act and s. 20.1(2)(b) of the Regulations.
