U.K. Gill Corp. (“UGC”), Rajinder S. Gill (“R. Gill”), and Nilam Gill (“N. Gill”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder without a valid BC Housing (“BCH”) Residential Builder Licence between the period of, or about, October 31, 2018, and April 3, 2019, regarding two new homes in Abbotsford, BC (the “New Homes”). On April 3, 2019, BCH issued Compliance Order 19-0003 to UGC, R. Gill and N. Gill directing that UGC, R. Gill and N. Gill:
- immediately cease carrying on the business of a residential builder as defined in the Act, and cease construction activities on the New Homes; and
- prior to resuming construction on the New Homes, provide BCH Compliance Department with proof that the New Homes are being built by a Licensed Residential Builder pursuant to section 14(1).
UGC, R. Gill and N. Gill were directed to comply with Compliance Order 19-0003 by May 24, 2019.
