On March 2, 2012, 0899869 B.C. Ltd. (“0899869”) and Wenda Deane (“Deane”) were issued a daily monetary penalty, jointly and severally, in the daily amount of $900, to a maximum of $4,500, for each day that passed where the contravention of s. 14(1) of the Homeowner Protection Act (the “Act”) continued. This Monetary Penalty was issued for the following reasons:
- 0899869 and Deane contravened s. 14(1) of the Act by acting in the capacity of a vendor developer regarding a new home in West Vancouver, B.C. (the "New Home"), by marketing the New Home for sale without the owner of the New Home, 0899869, being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”); and
- The contravention of s. 14(1) of the Act makes 0899869 and Deane subject to a monetary penalty pursuant to s. 28.3(1)(a) of the Act and s. 20.1(2)(b) of the Homeowner Protection Act Regulation.
