3D Construction Ltd. (“3DC”) and David Damon (“Damon”), contrary to section 14(5)(b) of the Homeowner Protection Act (the “Act”), published information implying and suggesting that 3DC and/or Damon is a licensed residential builder during the period of August 15, 2022, and February 7, 2023, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”). On February 7, 2023, BCH issued Compliance Order 23-0005 to 3DC and Damon directing that 3DC and Damon:
- immediately cease all signage, marketing, and other publications that imply, suggest, or hold out in any manner that either 3DC or Damon is a licensed residential builder; or
- immediately become a BCH LRB pursuant to section 14 of the Act.
3DC and Damon were ordered to comply with Compliance Order 23-0005 by March 17, 2023.
