Andrew Wepruk (“Wepruk”), Robert H. Granleese, (“R. Granleese”), Raegan Gibb (“R. Gibb”) Don Burrell (“Burrell”), George Gafiuk (“Gafiuk”), Harvey Griffith (“Griffith”), John Blackburn (“Blackburn”), Oscar Reimer (“Reimer”), William Granleese (“W. Granleese”), and Cave Hill Investments Ltd. (“CHIL”), contrary to Section 22(1.1) of the Homeowner Protection Act (the “Act”), sold a new home in Peachland, B.C. (the “New Home”), on, or about, December 5, 2012, without the New Home being registered for coverage by home warranty insurance provided by a warranty provider. On September 18, 2013, the HPO issued Compliance Order 13-0039 to Wepruk, R. Granleese, R. Gibb, Burrell, Gafiuk, Griffith, Blackburn, Reimer, and W. Granleese, and CHIL, directing that they:
- Immediately registered the New Home for coverage by home warranty insurance provided by a warranty provider pursuant to section 22(1) of the Act; or
- Provide the HPO with proof that the New Home is enrolled in a policy of home warranty insurance pursuant to section 22 of the Act.
Wepruk, R. Granleese, R. Gibb, Burrell, Gafiuk, Griffith, Blackburn, Reimer, and W. Granleese, and CHIL were directed to comply with Compliance Order 13-0039 by October 4, 2013. Complied.
