Ar-Man Construction & Development Ltd. (“ACD”), Gurnek (Niki) Sandhu (“G.N. Sandhu), Dalbinder Sandhu (“D. Sandhu”), Arjanjeet Sandhu (“A. Sandhu”) and Gurarman Sandhu (“G. Sandhu”) (G.N. Sandhu, D. Sandhu, A. Sandhu and G. Sandhu together, “the Sandhus”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder without a valid BC Housing (“BCH”) Residential Builder Licence between the period of, or about, April 4, 2018, and May 28, 2018, regarding a new home in Richmond, BC (the “New Home”). On May 28, 2018, BCH issued Compliance Order 18-0037 to ACD and the Sandhus directing that ACD and the Sandhus:
- immediately cease carrying on the business of a residential builder as defined in the Act, and cease construction activities on the New Home; and
- prior to resuming construction on the New Home, provide BCH Compliance Department with proof that the New Home is being built by a Licensed Residential Builder pursuant to section 14(1) of the Act.
ACD and the Sandhus were directed to comply with Compliance Order 18-0037 by July 13, 2018.
